The terms on which Stoneline Heritage offers this website and provides heritage restoration and building services across New South Wales.

These terms of service (“Terms”) set out the basis on which Stoneline Heritage (ABN 80 691 951 762), an NSW-based heritage restoration and building practice (“we”, “us” or “our”), offers this website and provides its services. By using this website or engaging us to carry out work, you (“you” or the “Client”) accept these Terms. If you do not agree, please do not use the website or our services.
1. About us
We are a specialist trade carrying out heritage restoration, stone and masonry repair, façade work, salt and rising-damp treatment, tiling, rendering, waterproofing and decorative restoration for residential, strata, commercial and public buildings. We operate across Sydney and wider New South Wales. We act as a specialist trade or subcontractor on selected stages of a project, and can also take a single-trade scope directly from an owner. We are not a head contractor for fit-out, joinery or kitchen works.
2. Using this website
This website is provided to help you understand our services and to make an enquiry. You may view, download and print pages for your own personal, non-commercial use. You must not misuse the site (for example, by attempting to disrupt it, submitting misleading or unlawful content, or using content in breach of intellectual property rights).
We try to keep the website accurate and up to date, but it is general information only. It is not advice (legal, engineering, building or conservation advice) and it is not a quote or a contract. Where we refer to techniques, materials or statutory processes, those references are illustrative and may not apply to your building without an on-site assessment.
3. Enquiries, quotes and assessments
You can request a site assessment through the contact form. The information and photographs you provide are used to understand the work and respond to your enquiry; our handling of that information is explained in our Privacy Policy.
Unless we agree otherwise in writing, an initial response or site visit is provided to assess the work and is not a commitment to undertake it. Any estimate, indication of cost or quote we provide is an invitation to treat only. We are only engaged, and no binding contract for work is formed, when you and we sign a written scope of works (or otherwise agree in writing). Until then, neither party is bound to proceed.
4. Scope of works and variations
Work is carried out in accordance with the written scope of works, which records the works, the materials and methods, the stages and any exclusions. Anything outside the agreed scope is a variation. Variations must be agreed in writing (including any price adjustment) before that work is carried out, and become part of the scope.
Heritage and older buildings often contain concealed conditions (for example, hidden decay, prior incompatible repairs, asbestos, or moisture and salt not visible at quoting). If such conditions are found during the work, we will advise you promptly and, where additional work is required, seek your written agreement as a variation.
5. Approvals, listing and heritage controls
Many buildings we work on are heritage-listed or located in heritage conservation areas. Confirming listing or conservation-area status, and obtaining any council, Heritage NSW or other consent, exemption or approval required before works begin, is the owner’s responsibility. We will coordinate with you, your heritage consultant, architect or the relevant council where engaged to do so, but we are not responsible for obtaining approvals unless expressly agreed in the scope of works.
6. Licences, insurance and statutory compliance
We carry out work in accordance with applicable NSW law, including the Home Building Act 1989 (NSW) where it applies to residential building work. For residential building work within the Act, we hold the relevant licence and, where required, Home Building Compensation Fund (HBCF) cover, evidence of which we can provide for your project. We maintain public liability insurance and can provide a current Certificate of Currency on request. Specific licence numbers, HBCF details and certificate information are confirmed for each project during assessment.
7. Site access and your responsibilities
You agree to provide reasonable and safe access to the building, including any scaffolding or platform access arranged through others, and to make the work area available during the agreed periods. You are responsible for the accuracy of the information you give us about the building, for moving or protecting personal property at or near the work area, and for arranging any services (such as water, power or facilities) we reasonably need to carry out the work.
8. Payment
The price, progress-payment schedule, GST treatment and payment timing for each project are set out in the written scope of works. Unless otherwise agreed, invoices are payable within the period stated on the invoice. Where the Home Building Act 1989 (NSW) and its progress-payment rules apply to residential building work, our payment terms comply with those rules. We may charge reasonable costs to recover overdue amounts where permitted by law.
9. Warranties
Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including that the work will be carried out with due care and skill. Where the statutory warranties under the Home Building Act 1989 (NSW) apply to residential building work, those warranties (major work: six years; minor work: two years, from completion) apply to the work we perform. We also provide our own workmanship warranty on the terms set out in the scope of works. Material and product warranties are subject to their manufacturers’ terms and correct installation. Our warranty does not cover damage caused by ongoing moisture, salt or structural movement that the scope of works was not engaged to address, or by third parties after handover.
10. Limitation of liability
To the fullest extent permitted by law, our liability for any claim arising out of or in connection with the services (other than a liability that cannot be excluded by law, such as a guarantee under the Australian Consumer Law) is limited, at our option, to re-supplying the services, re-performing the affected work, or paying the reasonable cost of having the affected work re-done. We are not liable for indirect, consequential, special or financial loss (including loss of revenue, profit or opportunity) except where we cannot lawfully exclude it. Nothing in these Terms excludes, restricts or modifies any consumer guarantee or other right you have under any applicable law that cannot be excluded.
11. Your content and project photographs
You confirm that any photographs, reports or information you give us through the website or otherwise are yours to provide. With your approval, we may use photographs of completed work for our portfolio, website and marketing. We will take care with your privacy; if you would prefer we not use images of your project, please tell us in writing and we will respect that. We retain ownership of our methods, documentation, designs and the content of this website.
12. Privacy
Our collection, use and handling of your personal information is described in our Privacy Policy, which forms part of these Terms by reference.
13. Changes to these Terms
We may update these Terms from time to time. The “last updated” date above records when they were last revised. Terms that apply to a particular project are those agreed in the written scope of works for that project.
14. Governing law and disputes
These Terms and any contract formed with us are governed by the laws of New South Wales, Australia. If a dispute arises, we will try to resolve it with you in good faith first. Building disputes in NSW can also be referred to NSW Fair Trading, and where unresolved to the appropriate tribunal or court of New South Wales. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
